These Terms of Service (“Terms”) govern your use of the SolvingHealth platform and all associated products operated by SolvingHealth Technologies LLC (“SolvingHealth,” “we,” “us,” or “our”). By accessing or using our Services, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using any SolvingHealth Service, you confirm you are at least 18 years old (or are a parent/guardian authorizing a minor’s account), have the legal capacity to enter into these Terms, and agree to be bound by them.
2. Description of Services
SolvingHealth provides health information technology services including:
- ComfortCard: Personal health identity and HSA/FSA management
- co-op.care: Worker-owned companion care coordination
- CareGoals: Advance care planning and legacy capture
- ClinicalSwipe: Physician peer review marketplace
- SolvingHealth Platform: Health IT infrastructure for developers
Our Services are informational and coordinative in nature. They do not constitute the practice of medicine. Letters of Medical Necessity (LMNs) are physician-reviewed documents — they are not diagnoses or treatment recommendations.
3. Health Information Disclaimer
SolvingHealth is not a healthcare provider. Content on our platform, including AI-generated summaries and Sage AI responses, is for informational purposes only and does not substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional.
4. Account Responsibilities
- You are responsible for maintaining the confidentiality of your login credentials
- You must provide accurate information when creating your account
- You are responsible for all activities that occur under your account
- Notify us immediately through our contact form if you suspect unauthorized access
5. Health Records Authorization
When you connect health records through Fasten Health or other integrations, you authorize SolvingHealth to retrieve and store your FHIR-formatted health records. You may revoke this authorization at any time. You represent that you have the right to share any health information you provide.
6. Payment
Nothing on SolvingHealth is for sale today. If that changes, the terms for any purchase will be shown before you buy anything, and these Terms will be updated first.
7. Cooperative Equity (Care Circle)
Care Circle members earn cooperative equity credits at a rate of 1% of qualifying transactions. These credits represent a beneficial interest in co-op.care Technologies LLC. Equity terms, vesting, and conversion rights are governed by the co-op.care Member Agreement, which is a separate document. Equity credits have no guaranteed cash value.
8. Prohibited Uses
You agree not to:
- Use the Services for any unlawful purpose
- Submit false health information or impersonate another person
- Attempt to reverse-engineer or extract our AI models or proprietary algorithms
- Use automated scrapers or bots against our platform
- Interfere with the security or integrity of the Services
9. Intellectual Property
SolvingHealth retains all rights to our platform, AI models, brand, and technology. You retain all rights to your personal health information. You grant us a limited license to process your data solely to provide the Services.
10. Limitation of Liability
To the maximum extent permitted by law, SolvingHealth’s liability for any claim arising from these Terms or the Services is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
11. Indemnification
You agree to indemnify and hold SolvingHealth harmless from claims arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
12. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration in Boulder County, Colorado, except where prohibited by law.
13. Changes to Terms
We may update these Terms. We will notify you of material changes at least 30 days in advance via email. Continued use after the effective date constitutes acceptance.
